Terms of use and sale

These terms govern access to and use of the Transferable service, a file delivery tool intended for imaging professionals and individuals alike. Accepting them is a prerequisite to opening an account.

Purpose of the service

Transferable makes it possible to host files, to compose delivery pages from them and to send those pages to recipients by means of a link. Online playback is offered in reduced quality; only downloads provide the original files.

Account

Opening an account requires a valid email address and a username. The user is responsible for the use made of their account and for the content they upload. They warrant that they hold the rights to the files transmitted.

Plans, prices and trial

• The service is offered under several plans described on the pricing page. Prices are shown excluding tax; applicable VAT is added in accordance with the regulations in force.
• A fourteen-day trial is offered on first subscription to the Starter plan. No amount is charged before the end of the trial; the payment method is merely recorded. The Pro and Max plans are payable upon subscription.
• The subscription renews automatically at the end of each term. It may be terminated at any time; access then runs until the end of the period already paid for.

Right of withdrawal

Consumers have a period of fourteen days in which to exercise their right of withdrawal, running from the date of subscription.

The Starter plan begins with a fourteen-day trial with no charge: terminating during the trial therefore gives rise to no payment.

By subscribing, the user expressly requests immediate performance of the service and acknowledges that, where withdrawal occurs after the first payment, the refund is calculated pro rata to the unused part of the period.

Referrals and free account

A user with an ongoing subscription may invite third parties by means of a personal link. The invited person opens a free account with ten gigabytes of storage, with no premium features and no payment method. This account can be obtained through this route alone, and a given email address may benefit from it only once.

• "For life" means for as long as the account is active. Beyond twelve consecutive months without a sign-in, a warning email is sent to the user; failing a sign-in within the following thirty days, the account and the files it contains are permanently deleted. A single sign-in is enough to stop this countdown.
• The referrer receives ten additional gigabytes of storage for each invited person who has actually sent a first delivery, up to ten people. This additional storage applies only for as long as their own subscription is ongoing.
• When an invited person takes out a subscription, the referrer is credited with the monthly amount of their plan, once the invited person's first invoice has actually been collected. The credit is applied to their subsequent invoices and gives rise to no cash refund.
• The publisher reserves the right to refuse or cancel a referral in the event of misuse, in particular the creation of multiple accounts by the same person.

Content and liability

Uploaded files remain the property of the user. The publisher exercises no prior editorial control but reserves the right to suspend an account in the event of unlawful use. The service is provided "as is"; the publisher applies reasonable means to ensure its availability without guaranteeing absolute continuity.

Governing law and jurisdiction

These terms are governed by French law. Failing an amicable settlement, any dispute will be brought before the competent courts of Clermont-Ferrand, without prejudice to the mandatory rules of jurisdiction applicable to consumers.

This document is published in several languages. In the event of any discrepancy between versions, the French version prevails. The applicable law is French law.
